AUTOGRILL FRANCE: General Conditions of the "TRUCKER" Loyalty Program for Truck Drivers and Ambulance Drivers

1. Presentation of the loyalty program :

The Loyalty Program is a free program, offered by AUTOGRILL to reward truck drivers for their loyalty. Drivers who sign up automatically and free of charge benefit from a "Groups Service France" membership card, allowing them to obtain a certain number of advantages set out below on all AUTOGRILL establishments on the French motorway network (metropolitan) excluding :

  • vending machines, hotels and shops operated by Autogrill

In the restaurants present at the Carrousel du Louvre in Paris, and managed by AUTOGRILL, this program is not valid.

This loyalty program does not benefit:

  • Professional guides: find out about the benefits and conditions from Groups service;
  • Tourist coach driver: find out about the advantages and obtaining the card on www.autogrill.fr .

2. Membership conditions and registration process:

The program is open to any truck driver or military transporter of goods, and to any ambulance driver, whatever their nationality, and holder of:

  • A valid PL license;
  • A roadmap OR an employer's certificate from a transport company less than one month old OR for military personnel, a certificate from their superior indicating their goods transport function OR any other document proving the existence of a truck driver activity.

The membership of the Truck Driver (or ambulance driver or military person transporting goods) in the program implies his/her unreserved acceptance of these general conditions, which he/she declares and acknowledges having perfect knowledge of them.

To register, the truck driver can:

  • request your loyalty card at one of our motorway restaurants and activate it OBLIGATORILY via the website www.autogrill.fr . Once the request has been made, the card will be active within 72 working hours.
  • request your loyalty card via:

Supporting documents will be requested regardless of the method of membership.
This card is free, nominative and strictly personal. It cannot be transferred and is in no case a payment card. The loyalty card cannot be combined with other programs and loyalty cards in force at AUTOGRILL, in particular with the "Bus" loyalty card. The member (or hereinafter "the Buyer") may not have in his possession 2 active "Trucker" loyalty cards.
Furthermore, the advantages of the Trucker loyalty program are also not cumulative with any other promotion and/or advantages in force at AUTOGRILL.
In the event of a card renewal (following loss, theft or damage to the old one), the member will not benefit from any advantages in the restaurants, the time for him to make a new card.
As the transfer of points to the new card is not automatic, the member must request it from Groups service.
The advantages of the program are valid until 31.12.2025

3. Advantages

To benefit from the advantages, the Truck Driver must present, obligatorily and each time he goes through the checkout his “Trucker” loyalty card under the conditions defined below.

3.1 – On all AUTOGRILL establishments on the motorway network in metropolitan France Starbucks, brioche dorée, la croissantrie, Ciao Restaurant, Territoires de France, Exki, Bistrot, Overgne, Spizzico.

Upon presentation of his loyalty card, the Truck Driver will benefit from the following advantages:

  • A discount of 20% will be applied to his receipt if it reaches a minimum value of €11.
    As part of his meal, the driver will have his coffee offered;

3.2 – At Mc Donald’s, Mc Café and Burger King establishments in the Autogrill network in metropolitan France:

Upon presentation of his loyalty card, the Truck Driver will benefit from the following advantages:

  • A discount of 20% will be applied to his receipt.

3.3 – In the event that the truck driver does not have a loyalty card:

  • If the truck driver does not wish to join the loyalty program or if he is waiting for his “Trucker” loyalty card to be activated (activation must be done within 10 days maximum if the membership form has been fully completed and legibly), the truck driver does not benefit from any advantage or reduction.

4. Scope of application:

These general conditions apply to the services defined above, concluded between the truck drivers and AUTOGRILL France.

These general conditions are communicated to the Buyer (Driver member ) upon simple request by email or mail to the address of AUTOGRILL.

No special condition may, except with the formal and written acceptance of AUTOGRILL, prevail over these general conditions. The fact that AUTOGRILL does not avail itself at any time of these general conditions cannot be interpreted as a waiver of the right to avail itself subsequently of any of these conditions.

5. Buyer's Acceptance:

These general terms and conditions of sale are expressly agreed to and accepted by the Buyer, who declares and acknowledges having perfect knowledge of them, and therefore waives the right to rely on any contradictory, prior document and in particular, its own general terms and conditions of purchase.

6. Exclusion from the loyalty program:

6.1 - Failure to comply with the rules or misuse of the loyalty card

In the event of suspected fraudulent use of the card, or inappropriate behavior towards AUTOGRILL staff, AUTOGRILL reserves the right, at any time, and without notice, to remove the driver holding the card from the loyalty program and to cancel the benefits obtained on the date of removal.

The frauds and behaviors retained (non-exhaustive list) are: Threatening attitude, verbal or physical aggression towards all AUTOGRILL staff, lending the loyalty card to any third party, misuse of the loyalty card at the same stop for the purpose of benefiting several times the same benefits, abusively exceeding the number of items offered in each promotional menu, direct resale to coach passengers of the items offered by AUTOGRILL using the points accumulated on the card.

AUTOGRILL also reserves the right to take any action it deems useful in the event of inappropriate behavior by the beneficiaries of the Program or fraudulent or abusive use of the card (in particular, the withdrawal of non-active cards when going through the checkout). Any breach of these general conditions, any falsification of information transmitted to the AUTOGRILL headquarters, will automatically result in the removal of the cardholder from the card.

6.2 - Non-use of the loyalty card

In the event of non-use of the card by a member over a period of 12 months, AUTOGRILL reserves the right to deactivate his loyalty card and consequently to terminate the Buyer's membership in this loyalty program.

7. Entry into force, termination:

The Contract is considered concluded upon acceptance of these general terms and conditions by the member.

At any time, the driver may cancel his registration by mail with acknowledgment of receipt sent to AUTOGRILL at the address given below, subject to one month’s notice. Such termination results in complete withdrawal from the Program and, consequently, the removal of the benefits associated with it.

8. Termination of the loyalty program:

AUTOGRILL reserves the right to cancel the loyalty program at any time, subject to informing the loyalty card holders by any means deemed necessary, with one month's notice, without truck drivers, military personnel transporting goods and ambulance drivers being able to claim any compensation.

The loss of the operating authorization by AUTOGRILL for any reason whatsoever of an establishment results in the automatic cancellation of membership in the "Truckers" loyalty program for this establishment without the driver being able to claim any compensation for this reason. AUTOGRILL undertakes to inform the said driver in writing of this loss as soon as he becomes aware of it.

The Card remains the exclusive property of AUTOGRILL and can be returned to him upon request.

9. Force Majeure:

Each Party shall be released from liability in the event that it becomes impossible for it to perform part or all of its obligations due to the occurrence of events having the character of force majeure and beyond the control of the debtor party, which could not reasonably have been foreseen when the contract was concluded and the effects of which cannot be avoided by appropriate measures, as usually retained by case law and defined within the meaning of Article 1218 of the Civil Code.

The Party invoking an event constituting force majeure or fortuitous events must notify the other Party by any means, following the occurrence or threat of this event and this within a maximum period of five days. The execution of the obligations of the prevented Party will then be postponed by a period equal to that of the duration of the suspension due to this cause.

The Parties agree that they must consult each other as soon as possible in order to take all reasonably possible measures to continue the execution of the contract.

However, beyond a period of one month of interruption due to force majeure, each Party may choose to terminate this contract automatically, by registered letter with acknowledgment of receipt sent to the other Party, without compensation from either party.

10. Liability:

AUTOGRILL declines all liability concerning the direct or indirect consequences of any anomaly or malfunction of the AUTOGRILL loyalty card, whatever their causes. AUTOGRILL will nevertheless make its best efforts to preserve for each member in the event of a malfunction or anomaly, the benefit of their accumulation of points or their advantages.

11. Complaints, dispute resolution and mediation:

11.1 - Complaints

Any complaint from the member of the Program must be the subject of a letter addressed to AUTOGRILL at the MARKETING department – ​​Loyalty Program “Truckers” – 18, Rue Jacques Réattu – BP 81, 13275 MARSEILLE CEDEX 09.

The Driver indicates the subject of his complaint and attaches any appropriate supporting documents directly related to his complaint.

11.2 - Dispute resolution

These General Terms and Conditions are subject to French law. In the event of a dispute, the dispute will be submitted to the courts of Marseille.

In the event of a dispute, the Customer may first contact AUTOGRILL in order to seek an amicable solution.

11.3 - Consumer mediation

In accordance with Articles L.611 to L.616 and R.612 to R.616 of the Consumer Code, following the transposition of European Directive No. 2013/11/EU of 21 May 2013 relating to the out-of-court settlement of consumer disputes, the Buyer may use a consumer mediator free of charge with a view to resolving a dispute between them and AUTOGRILL.

The consumer must provide proof of having contacted the AUTOGRILL Marketing department in writing at the address referred to in Article 18 above to attempt to resolve their dispute and not having received a satisfactory response within a period of two months. He must contact the Mediator within a maximum of one year from his written complaint to the AUTOGRILL Marketing department.

The Mediator can be contacted either online ( https:// www.mediationconso-ame.com ) by completing the form provided for this purpose, or by post: AME CONSO, 197 Boulevard Saint-Germain, 75007 Paris.

The referral must include the Buyer's full contact details (last name, first name, postal address, email and telephone number), a copy of the complaint sent to the marketing department and the response received, a brief summary of the facts of the Buyer's request and all supporting documents supporting his request (invoice, proof of payments, etc.).

The outcome of the mediation will be reached at the latest within 90 days from the referral to the mediator, unless the latter decides to extend this period in the event of a complex dispute.

Finally, if the opinion given by the Mediator does not satisfy either Party, they are not obliged to accept it and may consider legal action in accordance with the provisions of Article 19 hereof.

12. Intellectual property:

All advertising and/or technical documents provided to the Buyer remain the exclusive property of AUTOGRILL, the sole holder of intellectual property rights. The Buyer undertakes not to use these documents in a way that could infringe on AUTOGRILL’s intellectual property rights.

13. Privacy and personal data:

AUTOGRILL COTE FRANCE, having its registered office at 18 rue Jacques Réattu, BP81, 13275 Marseille Cedex 09 ("Autogrill" or "Company" or "we" or "our"), acting as the controller of personal data ("Data Controller"), informs you that your personal data is processed by electronic and non-electronic means, in accordance with logic and procedures related to the purposes set out below and in compliance with the General Data Protection Regulation (GDPR), including the principles of confidentiality and security.

Purposes of the processing necessary for the management of the Loyalty Program

AUTOGRILL collects the personal data that you provide in the context of its commercial activity, including details of orders placed online, and through your interactions with AUTOGRILL.

AUTOGRILL processes your personal data in order to manage the Truck Driver loyalty cards and to provide you with the associated services, for statistical and archiving processing purposes, for commercial prospecting purposes. The communication of data is necessary for the purposes indicated above and any refusal could prevent you from benefiting from the Truck Driver Loyalty Program and the associated services. In accordance with the GDPR, your personal data may be used periodically to update or correct information previously collected.

Personal data is intended for use by our duly authorized personnel (e.g., retail sales personnel). If you have consented to the processing of your personal data, the data relating to orders placed are recorded for marketing purposes for a period of 3 years in internal archives and 5 years in external archives, the data relating to commercial prospecting are retained for 3 years from the last commercial contact. At the end of these periods, the data will be automatically deleted or made anonymous in a permanent and irreversible manner.
