AUTOGRILL France General Conditions of the “BUS” Loyalty Program
To the attention of coach drivers
Version effective January 1, 2024

1. Presentation of the loyalty program:

The Loyalty Program is a free program offered by AUTOGRILL to reward touring coach drivers for their loyalty (hereinafter referred to as “the Program”).

Drivers who register automatically benefit free of charge from a “Groups Service France” membership card allowing them to obtain a certain number of advantages set out below on all AUTOGRILL establishments on the French motorway network ( mainland) excluding :

  • vending machines, hotels and shops operated by Autogrill.

On the FoodCourt Rivoli at the Carrousel du Louvre in Paris managed by AUTOGRILL, this program is not valid. On a commercial basis, a free meal (worth €25 maximum) will be granted to the driver, only in the event of a group menu reservation on the Carrousel (he will not be entitled to a gift voucher or to accumulate points on his card).

This loyalty program is not valid for:

  • The professional guide: upon presentation of the original of his valid professional card, and having been identified as a group guide, he will benefit from a free meal, breakfast or snack break, at due to only one professional guide per coach;

2. Membership requirements and registration process:

The program is open to any tourist or military bus driver transporting passengers, whatever their nationality (hereinafter referred to as “ the Member ”), and holder of:

  • A valid bus permit;
  • A roadmap OR a certificate from an employer of a tourist transport company less than one month old OR for military personnel a certificate from their superior mentioning their passenger transport function OR any other document proving the existence of a bus driver activity.


Membership by the tourist coach driver implies his unreserved acceptance of these general conditions, who declares and acknowledges having perfect knowledge of them.

To register, the driver can request their loyalty card via:

  • the website www.autogrill.fr “professionals / bus driver” section;
  • by email to groups.service.fr@autogrill.net ;
  • in the 2 cases stated above, an active card will be sent to the address indicated on the membership form within 4 to 5 working days upon receipt of the request (if it is complete).


Supporting documents will be requested regardless of the membership method.

This card is free, nominative and strictly personal. It cannot be transferred and is in no way a payment card. The loyalty card cannot be combined with other loyalty programs and cards in force at AUTOGRILL, in particular with the “Trucker” loyalty card. The tourist coach driver cannot have 2 active bus loyalty cards in his possession.

In the event of renewal of the card (following loss, theft or deterioration of the old one), the member will not benefit from any advantage in restaurants, while it takes time to renew a card.

As the transfer of points to the new card is not automatic, the member must make a request to Groups service.

Program benefits are valid until 12/31/2024.

3. Conditions and Benefits:

3.1 - Going full:

- 3.1.1 Conditions of obtaining:
To benefit from the advantages, the driver must:

present MANDATORYLY at EACH checkout :

  • the Autogrill France “Bus” loyalty card;
  • An official identity document (passport, identity card, driving license), bearing the same name and first name as the Autogrill France “Bus” loyalty card
  • the route sheet (paper or electronic) mentioning 20 people minimum , the current date and the name of the driver.

If the driver only presents one or the other of these 3 documents, full benefits cannot be granted to him.

- 3.1.2 Benefits that can be combined with all AUTOGRILL establishments on the motorway network in mainland France (except McDonald's, Mc Café and Burger King):

  • A meal will be offered to the Member under the following conditions:
    • Program pricing conditions:
      • A meal worth a maximum of €25 in the SSR (notably Ciao, Cafétéria AUTOGRILL COTE France, Territoires de France and Bistrot);
      • A meal worth a maximum of €12 in fast food brands, including Brioche Dorée, La Croissanterie, Spizzico, Starbucks and Exki.
    • The meal must be composed as follows, without exceeding for each Member:
      • For breakfast : a hot drink + fruit juice + 1 pastries + 1 roll + 1 butter + 1 jam;
      • For a self-service lunch or dinner : a starter + a hot garnished main course + a dessert or cheese + a cold drink + a hot drink;
      • For a fast food lunch or dinner : a cold or hot sandwich + a dessert + a cold drink + a hot drink;
      • For a lunch or dinner with table service : (only if the driver is with a group having reserved a “group menu” with the reservation center): the driver will benefit from the same menu as the reserved group;
      • For a snack : a hot drink or a cold drink + a pastry or pastries.
  • A Kadéos check worth €10 will be given to the Member on their 2nd visit (on presentation of the nominative coupon which will have been given to you during your first visit, subject to respecting a minimum period of 3 hours between the 2 visits ).
  • A point will be accumulated on the Member's loyalty card (Limited to 1 point per coach and per passage, even if there are several drivers in the same coach).


The coach driver can find out his points balance by consulting his receipt, visible opposite the “new points balance”.

The above advantages benefit the second driver of the same coach, with the exception of the advantages relating to obtaining the gift voucher and the accumulation of points which do not apply to him.

THE DRIVER WILL ONLY BE ABLE TO BENEFIT FROM ALL THESE ADVANTAGES TWICE IN THE SAME DAY AND ON TWO DIFFERENT STOPS WHICH MUST BE A MINIMUM OF 3 HOURS SEPARATED

Beyond these 2 passages, no more advantages will be granted to the Member.

- Services :

- Skip the line:

If he requests it, the driver can benefit from the “skip the line” service in self-service only: the meal service for the driver alone will then be done outside the queue.

- 3.1.3 Advantages over McDonald's, McCafé and Burger King establishments on the French AUTOGRILL motorway network (metropolis):

  • A meal will be offered and must be composed as follows * , without exceeding:
    • For breakfast : a hot drink + fruit juice + 1 or 2 pastries
    • For lunch or dinner : an XL menu including 1 burger or similar + a fries or similar + a drink + a coffee
    • For a snack : a hot drink or a cold drink + a pastry or pastries.
  • No gift certificate will be given to him
  • No points will be accumulated on their loyalty card

3.2– Dry run:

- 3.2.1 Conditions for obtaining:
To benefit from the advantages, the driver must:

present MANDATORYLY at EACH checkout :

  • the Autogrill France “Bus” loyalty card;
  • An official identity document (passport, identity card, driving license), bearing the same name and first name as the Autogrill France “Bus” loyalty card
  • the route sheet (paper or electronic) mentioning the current date and the name of the driver;



Be in the following cases:

  • Have a roadmap mentioning less than 20 people and the current date and the name of the driver
  • MUST have a credit of at least 10 points on your card (10 points = 1 free meal).



THE DRIVER WILL ONLY BE ABLE TO BENEFIT FROM THIS ADVANTAGE ONCE IN THE SAME DAY.

If he does not have sufficient points credit: no advantage or reduction can be granted to the Coach Driver who will have to pay for his meal.

- 3.2.2 Benefits that can be combined with all establishments on the AUTOGRILL motorway network in mainland France (except McDonald's, Mc Café and Burger King)

  • A meal will be offered to the Member under the conditions set out in article 3.1.2 above.

- 3.2.3 Advantages over McDonald's, Mc Café and Burger King establishments on the French AUTOGRILL motorway network (metropolis):

  • No meals will be offered at these points of sale in the event of an empty situation.

3.3 – Hot drinks:

- 3.3.1 Conditions for obtaining:

- 3.3.2 Benefits that can be combined with all AUTOGRILL establishments in mainland France, including Mc Donald's, Mc Café and Burger King
 

  • A hot drink of your choice offered at any time of the day.

3.4 - Absence of loyalty card:

If the bus driver does not have a loyalty card:

No advantage can be granted to drivers if they are not in possession of their loyalty card on the day of passage except if they are accompanied by a reserved group. In this specific case, he will benefit from a free meal. * under the conditions set out in article 3.1.2 above.

3.5 - Acceptance of Kadéos tickets:

Tickets Kadéos gift vouchers in the amount of €10 are accepted for payment in AUTOGRILL establishments (in stores & restaurants except in Mc Donald's, Mc Café and Burger King restaurants), throughout the French motorway network and in the FoodCourt Rivoli at the Carrousel du Louvre in Paris. They are also valid in many brands (to find out about them, go to the site www.kadeos.fr ).

4. Scope:

These general conditions apply to the services defined above, concluded between touring coach drivers and AUTOGRILL. It is specified that the “Groups Service France” brochure as well as any other prospectus, advertising or catalog has only informative and non-contractual value.

These general conditions are communicated to the member coach driver (hereinafter “the Buyer”) upon simple request by email or post to the AUTOGRILL address.

No special condition can, unless formal and written acceptance from AUTOGRILL, prevail over these general conditions. The fact that AUTOGRILL does not avail itself of these general conditions at any time cannot be interpreted as a waiver of the right to subsequently avail itself of any of these conditions.
 

5. Buyer’s Acceptance:

These general conditions of sale are expressly approved and accepted by the Buyer, who declares and acknowledges having perfect knowledge of them, and therefore waives the right to rely on any contradictory, previous document and in particular, his own general conditions of sale. 'purchase.

6. Exclusion from the loyalty program:

6.1 Breach of regulations or misuse of the loyalty card

In the event of suspicion of fraudulent use of the card, or inappropriate behavior towards AUTOGRILL personnel, AUTOGRILL reserves the right, at any time, and without notice, to remove the driver holding the card from the loyalty program and cancel the benefits obtained on the date of cancellation.

The frauds and behaviors retained (non-exhaustive list) are: Threatening attitude, verbal or physical aggressiveness towards all AUTOGRILL staff, loan of the loyalty card to any third party, abusive use of the loyalty card on the same stopping in order to benefit from the same advantages several times, excessively exceeding the number of items offered making up each promotional menu, direct resale to coach passengers of items offered by AUTOGRILL using the points accumulated on the card.

AUTOGRILL also reserves the right to take any action it deems useful in the event of inappropriate behavior by beneficiaries of the Program or fraudulent or abusive use of the card (in particular, the withdrawal of non-active cards during checkout). . Any breach of these general conditions, any falsification of information transmitted to AUTOGRILL headquarters, will automatically result in the cancellation of the card holder.

6.2 Non-use of the loyalty card

In the event of non-use of the card by a member over a period of 12 months, AUTOGRILL reserves the right to deactivate their loyalty card and consequently terminate the driver's membership in this loyalty program.

7. Entry into force, termination:

The Contract is considered concluded upon acceptance of these general conditions by the member.

At any time, the touring coach driver may cancel his registration by mail with acknowledgment of receipt sent to AUTOGRILL at the address given below with one month's notice. Such termination results in a complete withdrawal from the Program and, therefore, in the elimination of the benefits associated with the latter.

8. Termination of the loyalty program:

AUTOGRILL reserves the right to cancel at any time, subject to informing the loyalty card holders by any means deemed necessary, giving one month's notice, the loyalty program without the coach driver tourism cannot claim any compensation.

The loss of the operating authorization by AUTOGRILL for any reason whatsoever of an establishment leads to the automatic cancellation of membership in the “bus” loyalty program for this establishment without the driver being able to claim a refund. compensation for this.

The Card remains the exclusive property of AUTOGRILL and can be returned to it at its request.

9. Force Majeure:

The liability of each Party will be released in the event that it becomes impossible for it to perform part or all of its obligations due to the occurrence of events having the character of force majeure and beyond the control of the debtor party, which could not be reasonably foreseen when the contract was concluded and whose effects cannot be avoided by appropriate measures, as usually retained by case law and defined within the meaning of article 1218 of the Civil Code.

The Party invoking an event constituting force majeure or fortuitous events must notify the other Party by all means, following the occurrence or threat of this event and within a maximum of five days. The execution of the obligations of the prevented Party will then be postponed for a period equal to that of the duration of the suspension due to this cause.

The Parties agree that they must consult as soon as possible in order to take all reasonably possible measures with a view to continuing the execution of the contract.

However, beyond a period of one month of interruption due to force majeure, each Party may choose to terminate this contract automatically, by registered letter with acknowledgment of receipt sent to the other Party, and this without compensation from either side.

10. Responsibility:

AUTOGRILL declines all responsibility for the direct or indirect consequences of any anomaly or malfunction of the AUTOGRILL loyalty card, whatever their causes. AUTOGRILL will nevertheless make its best efforts to preserve for each member in the event of a malfunction or anomaly, the benefit of their accumulation of points or its advantages.

11. Complaint, dispute resolution and mediation:

11-1 Complaint

Any complaint from the Program member must be sent to AUTOGRILL Groups Services – “BUS” loyalty program – 18, Rue Jacques Réattu – BP 81, 13275 MARSEILLE CEDEX 09.

The member indicates the subject of their complaint and attaches any appropriate supporting documents directly related to their complaint.

11-2 Dispute resolution

These General Terms and Conditions are subject to French law. In the event of a dispute, the dispute will be submitted to the courts of Marseille.

In the event of a dispute, the Customer may first contact AUTOGRILL in order to seek an amicable solution.

11-3 Consumer mediation

In accordance with articles L.611 to L.616 and R.612 to R.616 of the Consumer Code, following the transposition of European directive no. 2013/11/EU of May 21, 2013 relating to the extrajudicial settlement of disputes consumption, the Buyer may have free recourse to a consumer mediator with a view to resolving a dispute between him and AUTOGRILL.

The consumer must prove having contacted the AUTOGRILL Marketing department in writing at the address referred to in article 11.1 above to try to resolve their dispute and not having obtained a satisfactory response within two months. He must contact the Mediator within a maximum of one year from his written complaint to the AUTOGRILL Marketing department.

The Mediator is contacted either via the internet ( https://www.mediationconso-ame.com ) by completing the form dedicated to this purpose made available to him, or by post: AME CONSO, 197 Boulevard Saint-Germain, 75007 Paris.

The referral must include the Buyer's full contact details (surname, first name, postal address, email and telephone number), a copy of the complaint sent to the marketing department and the response received, a brief summary of the facts of the Buyer's request and all supporting documents supporting his request (invoice, proof of payment, etc.).

The outcome of the mediation will occur no later than 90 days from the referral to the mediator, unless the latter decides to extend this period in the event of a complex dispute.

Finally, if the opinion rendered by the Mediator does not satisfy one or other of the Parties, they are not obliged to accept it and may consider legal action in accordance with the provisions of Article 19. hereof.

12. Intellectual property:

All advertising and/or technical documents provided to the Buyer remain the exclusive property of AUTOGRILL, the sole owner of the intellectual property rights. The Buyer undertakes not to make any use of these documents likely to infringe the intellectual property rights of AUTOGRILL.

13. Confidentiality and personal data:

AUTOGRILL COTE FRANCE, having its head office located at 18 rue Jacques Réattu, BP81, 13275 Marseille Cedex 09 (“Autogrill” or “Company” or “we” or “us”), acting as data controller of personal data ( “Data Controller”), informs you that your personal data is processed by electronic and non-electronic means, in accordance with logic and procedures linked to the objectives set out below and in compliance with the General Data Protection Regulation ( GDPR), including privacy and security principles.

> Purposes of processing necessary for the management of the Bus Driver Loyalty Program

AUTOGRILL collects the personal data you provide in the course of its business activity, including details of orders placed online, and through your interactions with AUTOGRILL.
AUTOGRILL processes your personal data for the purpose of managing Bus Driver loyalty cards and providing you with the associated services, for statistical processing and archiving purposes, and for commercial prospecting purposes. The communication of data is necessary for the purposes indicated above and any refusal could prevent you from benefiting from the Bus Driver Loyalty Program and associated services.

> Legal bases for processing

The legal bases for the processing of your data by AUTOGRILL are as follows:

  • your consent for carrying out commercial prospecting actions,
  • the legitimate interest of Autogrill to carry out commercial activities (and in particular, to inform about the latest offers and improve the customer experience),
  • Autogrill's legitimate interest in producing statistics to improve its reporting and offers
  • the execution of contractual relations between you and AUTOGRILL.


> Recipients of your personal data and communication to third parties.

In accordance with the GDPR, personal data about you may be used periodically to update or correct information previously collected.

Your personal data will be processed by Autogrill's Marketing Department, as well as its Information Systems Department and its Legal Department. Your personal data may be communicated to the Autogrill reservation center (service provider) and to IT service providers responsible for the maintenance and hosting of the website and information systems. Your personal data may also be transmitted to third parties in the following cases: (i) when the communication is required by law and regulations applicable to legitimate third parties, such as, for example, public authorities and bodies for institutional purposes, authorities responsible for enforcing anti-money laundering laws, or judicial authorities; (ii) in the event of extraordinary transactions (e.g. mergers, acquisitions, sale of businesses, etc.).

Personal data is intended for use by our duly authorized personnel (e.g. retail sales personnel). > Data retention

Your personal data is retained by AUTOGRILL for the period necessary to achieve the purposes for which your personal data is collected and for the fulfillment of legal and regulatory obligations.

If you have consented to the processing of your personal data, data relating to orders placed are recorded for marketing purposes for a period of 3 years in internal archives and 5 years in external archives, data relating to commercial prospecting are kept for 3 years from the last commercial contact. At the end of these periods, the data will be automatically deleted or made anonymous in a permanent and irreversible manner.

Furthermore, the data will be erased or anonymized permanently to achieve the aforementioned purposes, except in the case where AUTOGRILL is required to retain the data for an additional period in order to comply with legal or regulatory obligations.
